When you’re in the greater Toronto area, been charged with some minor criminal offences, overstayed your study, work or visitor permits, lost your asylum claim, or been accused of a bogus marriage and called for an interview at 6900 Airport Road entrance 93 with any CBSA Officer their task is to get you removed from Canada, THEY ARE NOT YOUR FRIENDS!
CBSA Officers will start with having you complete a simple form with what you may consider are simple non-evasive questions. They will ask you to bring in four passport size photographs for your interview.
TYPICAL QUESTIONS ON THE FORM ARE AS FOLLOWS;
What is your current residential address with postal code? It will ask have you been married since arriving in Canada? Are you currently married? Status of your spouse/partner who is in Canada? Do you have any children? Have you had any children born in Canada? Do you have any serious illness? Do you have any criminal convictions? Have you submitted an application for landing from within Canada? Are you currently before the courts for any outstanding charges? Are you currently being sponsored to Canada? Do you have any appeals currently before the Federal Court of Canada? What is your email address? Who is your emergency contact that is not a family member? What is your current cell phone number? Which cell phone company is your provider?
These questions are designed for your CBSA Officer to quickly ascertain if there is any IMPEDIMENTS that they may have to deal with that could delay your removal!
They will pretend to be your friend and they will inform you of certain things that could keep you in Canada because THEY KNOW THAT IS WHAT YOU WANT TO HEAR!
They may even start by cancelling an appointment or rescheduling an appointment that will slow down the removal process by calling you on your cell phone or emailing you. The more relaxed you becaome the better it is for them when they hit you with bring in a ticket with a removal date before DD/MM/YYYY!
Never answer their e-mails and definately never reply to any emails from them. Never click on and give them a read receipt. Never answer any calls starting from 905-405 or 905-676
Wake up why did they ask for 4 passport photos? They need a photo in your file incase you NO SHOW for an appointment so they can send out other CBSA Officers to arrest you by using one of those four photos to identify youo. They need photos for the airlines so they know the right person is being deported. They need a photo for your confirmation of removal form.
Yesterday I got a release order for one of my clients who NO SHOWED for a CBSA interview and during their detention review. The CBSA Officer sent several emails that my client responded to. The last e-mail informed him to come in for an appointment on a particular date that he did not attend on. I argued that there was no evidence he received the email requesting him attend 6900 Airport Road entrance 93 on that particular date. Ministers Counsel argued that my client had been responding to several previous emails within minutes of receiving them so on a Balance of Probabilities he received the request for an appointment and ignored it.
If CBSA Officers send you a call in notice by mail it takes two weeks and then they give you two additional weeks to show up. Regular Canada Post Snail mail does not prove that Canada Post delivered the letter.
I raised the issue that the particular CBSA Officer was not informing me of additional appointments for my client and that she knew I was his “Counsel”! Any communication should have been cc’d through me. The Immigration Division member agreed and suggessted I file a complaint.
Problem is why file a complaint when there is NO OVERSIGHT regarding CBSA Officers.
