To learn more go to www.cic.gc.ca and search for the CIC Manuals and locate the In Land Processing Manuals and specifically the IP5 manuals. See http://www.cic.gc.ca/english/resources/manuals/ip/ip05-eng.pdf Chapter 5.26 explains that the “Onus is on the applicant” to put forward any H&C factors they feel exist in their case and that officers do not have to elicit information not presented. IP5 Chapter 6.7 & 6.8 explains in detail the unusual and undeserved hardship definition. It informs the reader that the hardship must be something “not anticipated by the act or the regulations” and that the hardship, “in most cases, the result of circumstances beyond the person’s control”.
